Acceptable Use Policy

1. Purpose
This Acceptable Use Policy ("AUP") governs your use of the MPLEX Messaging Services platform ("Service") operated by MPLEX Technologies Limited. It supplements our Terms of Service and applies to all messages sent through the Service, whether via SMS, email, or any other channel we support.
All users, including API integrators, are responsible for ensuring that their use of the Service complies with this policy. Violations may result in immediate suspension or termination of your account.
2. Consent & Opt-In Requirements
You must have valid consent from each recipient before sending them a message through the Service. Specifically:
- Prior consent is mandatory. You must obtain express consent from recipients before sending any commercial or marketing messages. Consent must be documented and verifiable.
- Opt-in must be clear. Recipients must knowingly and voluntarily agree to receive messages from you. Pre-checked boxes, bundled consent, or consent obtained through deception do not qualify.
- Opt-out must be honoured.Every marketing message must include a clear way for the recipient to unsubscribe (e.g. "Reply STOP to opt out"). You must process opt-out requests within 24 hours and must not message that recipient again unless they re-subscribe.
- Transactional exceptions. Messages that are directly related to an existing transaction or relationship (e.g. order confirmations, appointment reminders, security alerts) do not require marketing opt-in, but must still be relevant and expected by the recipient.
3. Prohibited Content
You must not use the Service to send messages containing or promoting any of the following:
- Spam. Unsolicited bulk messages, regardless of content. This includes messages sent to purchased, scraped, or rented contact lists where recipients have not opted in.
- Phishing & fraud. Messages that impersonate banks, government agencies, carriers, or other entities, or that attempt to trick recipients into revealing personal information, credentials, or payment details.
- Malware & malicious links. Messages containing links to malware, viruses, spyware, or sites designed to exploit browser or device vulnerabilities.
- Illegal goods or services.Messages promoting or facilitating the sale of illegal drugs, counterfeit goods, unlicensed gambling, unlicensed financial services, or any activity that is illegal in Jamaica or in the recipient's jurisdiction.
- Hate speech & threats. Messages that promote violence, discrimination, or hatred against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
- Adult or explicit content. Sexually explicit material sent via SMS without verified age-gating and explicit consent from the recipient.
- Deceptive sender identity.Using a sender ID or "from" number that misleads the recipient about who is sending the message. Sender IDs must accurately represent your business or brand.
4. Prohibited Conduct
In addition to content restrictions, you must not:
- Send messages at volumes or frequencies intended to harass or overwhelm recipients
- Use the Service to conduct or facilitate denial-of-service attacks, toll fraud, or traffic pumping schemes
- Bypass or attempt to circumvent rate limits, sending restrictions, or account suspensions
- Share, resell, or sublicense access to the Service or your API credentials without our written permission
- Probe, scan, or test the vulnerability of the Service or attempt to gain unauthorized access to our systems
- Use the Service to collect phone numbers or personal data for purposes other than sending messages through the platform
5. Regulatory Compliance
You are responsible for complying with all laws and regulations that apply to your messaging activities, including but not limited to:
- The Jamaica Data Protection Act 2020 and any regulations issued under it
- The Telecommunications Act of Jamaica and the rules of the Office of Utilities Regulation (OUR)
- Anti-spam and electronic communications laws in the jurisdictions where your recipients are located (e.g. the US Telephone Consumer Protection Act, the Canadian Anti-Spam Legislation, the EU ePrivacy Directive)
- Carrier-specific messaging guidelines and sender registration requirements (e.g. 10DLC registration for US traffic)
MPLEX does not provide legal advice. If you are unsure whether your messaging use case is compliant, consult a qualified attorney before sending.
6. Message Volume & Rate Limits
We apply per-account rate limits to protect carrier relationships and delivery quality. These limits vary by destination country and channel and are communicated in your account dashboard and API documentation. Exceeding published limits may result in message queuing, throttling, or temporary suspension.
If you anticipate sending at high volumes, contact us in advance so we can provision appropriate capacity.
7. Monitoring & Enforcement
We monitor message traffic for patterns consistent with abuse, including unusually high complaint rates, carrier spam reports, and prohibited content. We reserve the right to:
- Inspect message content and metadata to investigate suspected violations of this policy
- Suspend or throttle your account immediately and without prior notice if we reasonably believe a violation has occurred or is imminent
- Permanently terminate your account for serious or repeated violations
- Report illegal activity to the relevant law enforcement authorities
We will make reasonable efforts to notify you of enforcement actions and give you an opportunity to respond, except where doing so would compromise an investigation or where immediate action is necessary to protect the Service, our users, or third parties.
8. Complaint Handling
If a recipient reports your messages as spam or unwanted, we will notify you and may require you to provide evidence of consent. You must respond to complaints within 48 hours. A pattern of complaints may result in account restrictions or termination regardless of whether individual consent can be demonstrated.
9. Your Responsibility
You are solely responsible for the content of messages you send through the Service and for maintaining compliant opt-in records. MPLEX Technologies Limited is not liable for any consequences arising from messages you send, including carrier fines, regulatory penalties, or legal claims from recipients.
10. Changes to This Policy
We may update this AUP from time to time to reflect changes in law, carrier requirements, or our own practices. We will post the revised policy on this page and update the "Last updated" date. Material changes will be communicated via email or dashboard notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised policy.
